These terms and conditions (TERMS) apply to your use of the Website and any purchases and services made through the Company. By using the Website, you (the CLIENT) agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Website.

Use of the Website

You may use the Evolve Auto Boutique WEBSITE only for lawful purposes and in accordance with these TERMS. You agree not to use the WEBSITE:

  • In any way that violates any applicable federal, state, local or international law or regulation
  • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the WEBSITE, or which may harm the Website or its users
  • To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter” or “spam” or any other similar solicitation

Intellectual Property

The WEBSITE and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof) are owned by Evolve Auto Boutique or its licensors and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our WEBSITE, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the WEBSITE for your own personal, non-commercial use and not for further reproduction, publication or distribution.

Limitation of Liability

Evolve Auto Boutique strives to meet and exceed industry standards in terms of our artistry and product quality. Evolve Auto Boutique warrants that our products meet these standards, but we cannot be held liable for any damage or issues that may arise from the surfaces to which our products are applied. Please note that we do not make any other warranties beyond this, and any statements or actions made by our officers, employees, or agents shall not be construed as constituting a warranty. Evolve Auto Boutique is committed to providing high-quality products and services, but we cannot guarantee the performance of the surfaces on which our products are applied.

Indemnification

By submitting any text, images, or data to us, you represent and warrant that you have all necessary permissions and rights to use such materials in connection with the production of any printed materials ordered from us. You agree to indemnify, defend, and hold harmless Evolve Auto Boutique and its employees, partners, affiliates, subsidiaries, and suppliers from and against any and all claims, demands, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to any alleged wrongful acts or infringement of copyright, patent, or proprietary rights of any third party or any matter that is libelous, slanderous, defamatory, scandalous, or obscene relating to the printing or production of any materials ordered by you. In the event of any such claim, you agree to defend Evolve Auto Boutique, pay any judgments or awards against you, and reimburse Evolve Auto Boutique for any legal fees and expenses reasonably incurred in responding to such claim.

Copyright & Trademarks

Unauthorized reproduction of copyrighted materials is strictly prohibited under the law. The CLIENT shall be solely responsible for obtaining any necessary permission from the originator prior to reproducing any copyrighted materials. Designer Wraps shall not be held liable for any infringement of copyright laws resulting from the reproduction of copyrighted materials, and shall assume that the CLIENT has obtained all necessary permissions before submitting any work for reproduction.

Artwork & Design

All design services provided by Evolve Auto Boutique under these terms shall be for the exclusive use of the CLIENT. Upon full payment of all fees and expenses, reproduction rights for all approved final designs created by Evolve Auto Boutique for this project shall be granted to CLIENT. All original artwork files created by Evolve Auto Boutique or parts contained therein, whether preliminary concepts or final visual presentation, remain the property of Evolve Auto Boutique and may not be used by the CLIENT without the written permission of Evolve Auto Boutique. Evolve Auto Boutique retains the right to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes, marketing materials, online posting on Evolve Auto Boutique websites, social media accounts, and photo portfolios. Evolve Auto Boutique will be considerate of product release or marketing campaign timelines in regards to any social media post(s) in regards to CLIENT project if notified prior to project start date. Where applicable, the CLIENT will be given any necessary credit for usage of the project elements. Evolve Auto Boutique is not responsible for errors in spelling, color, or design in regards to any and all artwork submitted by the CLIENT to Evolve Auto Boutique. It is assumed that all artwork submitted to Evolve Auto Boutique by the CLIENT has been approved by CLIENT prior to submission and is production ready. Not all Pantone (or PMS) colors can be exactly duplicated by digital printing due to contingencies (file type, color profile, palette, etc.). Evolve Auto Boutique will attempt to match any specific color requests. Should CLIENT require a printed proof prior to printing, please notify Evolve Auto Boutique, and we will arrange for a proof to be provided for an additional fee.

Proofing

Before any printing, you must approve either a digital or hard proof. CLIENT is responsible for any spelling, grammatical errors, numerical mistakes, etc. Evolve Auto Boutique will not print until CLIENT approval. Any changes after final approval of artwork will result in assessing additional charges for any time or materials used to make changes after our production process begins. Approval can come in the form of an email from CLIENT with clear indication of decision to move forward on the project.

Changes/Corrections/Errors

It is up to the customer to provided all the correct information. If artwork was provided by the customer, Evolve Auto Boutique is not responsible for any errors or quality of images or artwork. Once artwork is approved by CLIENT or CUSTOMER any changes done before and after production will have an extra cost depending on the size of the reprint and time of design making the changes. Evolve Auto Boutique reserves the right to correct inaccuracies, omissions, prices, descriptions, errors relating to productions, availability, and update information at any time, with or without prior notice.

If any job has problems due to an error on the part of Evolve Auto Boutique, we will re-image it free of charge. However, this does not include software limitations or improper set-up of a job by the CLIENT. Evolve Auto Boutique shall not be held responsible for errors in workmanship after the final client approval or neglect of final approval. No claims will be honored after 24 hours of receipt of any completed and delivered work. Although verbal orders will be accepted, Evolve Auto Boutique will not be responsible for any mistakes made verbally. It is strongly advised that all orders be made in writing, and any inaccuracies in verbal orders by the customer shall not be the responsibility of Evolve Auto Boutique.

Project Start Time

Upon receipt of all support files and items related to the completion of a project, and the approval of artwork by the CLIENT, the start time of the project will commence. The CLIENT accepts full responsibility for determining whether the purchased item will perform as required on the substrate(s) to which it is applied. Evolve Auto Boutique assumes no liability in this regard.

Job Cancelation

In the event that the CLIENT cancels an order before its completion, the CLIENT shall be liable for the cost of any proofs, artwork, materials re-stocking, and work performed up until the time of cancellation notice in writing. Additionally, Evolve Auto Boutique reserves the right to impose a 20% cancellation charge in addition to the actual charges to cover un-billed internal costs, including scheduling, communications, and resources utilized.

Vehicle Preparation

As a condition of our services, the CLIENT agrees to clean the vehicle thoroughly with soap and water at least 12 hours before the scheduled installation. Failure to comply with this requirement may result in an additional fee. We shall not be held responsible for any items contained within the vehicle during the installation process. You are solely responsible for removing any valuable items from the vehicle prior to the installation or drop-off.

It is the CLIENT’s responsibility to ensure that your vehicle is properly prepared before installation. Any recently applied finish must be fully cured for a minimum of 30 days prior to the film being applied.

Installation

In consideration of the purchase of vinyl material or similar materials from Evolve Auto Boutique, it is important to note that the material is often a plastic material that is subject to certain limitations. While we make every effort to make the product appear seamless, it is possible that there may be curves, bumps, rivets, moldings and deep-channeled curves that the material(s) may not fully conform to. In such cases, relief cuts or patches may need to be installed to cover these areas. Furthermore, stretching the vinyl and similar materials may result in some shrinkage as it attempts to return to its original form and dimensions. In the 90-day period following installation, any minor tenting or lifting resulting from such shrinkage will be addressed if deemed necessary.

To ensure optimal results, all vinyl and similar materials must be applied to a “like new” vehicle finish, with an excellent bond of the paint and its finish to the vehicle substrate. Any rust, bubbling, caulking, scratches, dents or other damage will be visible through the film, and such surface imperfections may damage the film or cause it to fail prematurely. Any areas that have been repaired with body filler must be sanded, epoxy primed, and finished with OEM paint or clear coat. Additionally, any areas with caulking must be re-caulked over the installed material.

Terms of Payment, Legal Fees & Disputes

Payment is due upon receipt of invoices unless credit terms have been extended in writing by an authorized representative of Evolve Auto Boutique. If payment is not received within 30 days, invoices are considered past due, and all current and future projects may be put on hold until the balance is paid in full. After 60 days, the account is considered delinquent, and interest will accrue at a rate of 1.5% per month on all outstanding balances. Expenses related to collections, including but not limited to court costs, fees, expenses, and reasonable attorney(s) fees, will be charged to any account placed with our collection service.

CLIENTS must notify Evolve Auto Boutique in writing of any disputes regarding an invoice within ten days of the invoice date. Failure to dispute the invoice in writing will be considered acceptance of the invoice. CLIENTS must return all disputed work, along with a written explanation. Once the investigation is complete, any errors on our part will be corrected, or the CLIENT’s account will be credited.

We are not responsible for any consequential damages or losses resulting from the sale, installation, printing, or delivery of our products. It is the CLIENT’s responsibility to read and understand our Terms & Conditions page on our website before contracting Evolve Auto Boutique to do any work. All quotations are valid for 15 days.

Estimates & Taxes

Upon receipt of job specification information provided and current material costs, Evolve Auto Boutique provides good faith estimates to its CLIENTS. Please note that pricing and schedule are subject to change upon receipt of artwork and approval of estimate. The pricing outlined in the estimate is valid for 10 days from the date of the quote and excludes packaging or shipping charges unless specified. However, please be aware that estimates are contingent upon strikes, accidents, fire, availability of materials and all other causes beyond our control.

Please note that Evolve Auto Boutique has a minimum order requirement of $150, and we require a 50% deposit upon approval of estimate/order and the remaining 50% upon delivery, based on agreed terms unless otherwise negotiated upfront. The client order is subject to applicable state and local taxes unless a Government Sales Tax Use and Exemption form is filled out and submitted denoting that said corporation is exempt from sales tax. Appropriate taxes will be applied to outstanding invoices until this document is received.

It is important to note that verbal orders will not be accepted, and everything must be in writing. Evolve Auto Boutique will not accept responsibility for inaccuracies in verbal orders by the CLIENT.

Payment Terms

A 50% deposit is required at time of order. The balance is due before the completed job leaves our premises.

Delivery & Pickup

We prefer the client to deliver/pick up their own vehicles and jobs. We do, however offer pick up and delivery for a nominal additional fee.

Returns

All custom-made products offered by Evolve Auto Boutique are non-refundable. If a CLIENT has any concerns with a project, the CLIENT must contact Evolve Auto Boutique in writing before proceeding with any chargebacks or credit returns. Evolve Auto Boutique will be given the opportunity to correct and resolve any disputes within 30 days by fixing the disputed project. Since all jobs are custom products, Evolve Auto Boutique must be given the opportunity to reprint or reinstall any job before the client issues any credit card chargebacks or returns.

In the event that the CLIENT issues a credit card chargeback or disputes a credit card transaction, the credit card company will issue an inquiry. If the credit card company’s decision is made in favor of Evolve Auto Boutique, the client will be held liable for all legal fees and professional research and discovery time associated with Evolve Auto Boutique having to file an Inquiry with the credit card company. If a credit card dispute is decided in favor of Evolve Auto Boutique and if Evolve Auto Boutique suffers any loss of credit card business associated with a CLIENT’s chargeback request, the client will be liable for all legal fees and any credit card business Evolve Auto Boutique is not able to process during this period of the dispute resolution.

In the event that the CLIENT fails to make payment in full on the invoice, the customer irrevocably authorizes Evolve Auto Boutique to remove the graphics supplied or take back any produced products. For printed vehicle graphics and color wraps, once the job is printed, delivered, and/or installed, all contracts are final, and no monetary refunds can be issued.

Disclaimer of Warranties

Evolve Auto Boutique warrants the installation and material applied for a period of one year. However, there shall be no warranty for horizontal direct sun exposure such as hoods, roofs, and/or deck lids, and any surface with less than a 10 degree slope shall not be warrantied. The wrap warranty is subject to the customer’s care of the vehicle and the outdoor/geographic conditions. It is highly recommended to hand wash only and avoid high pressure or power washing, using an ice scraper on window graphics or any harsh chemicals that may deteriorate the laminate on the vinyl adhesive. Sweeping or brushing off the windows with a soft broom and the use of a rear defroster will not damage the window wrap. In the event that specially designed products are needed to clean and polish the vinyl graphics, please refer to the manufacturer’s instructions. It is advisable to wait for a minimum of three (3) weeks before washing the vehicle once the window wrap has been applied.

Removals

All removals are subject to separate quotations. Removal of wraps, window tinting, etc. can be a time-consuming process, and our labor charges are hourly-based. Please note that Evolve Auto Boutique shall not be held liable for any damage caused to the paint, clear coat, or existing striping during the removal process.

It is essential to note that we cannot be held responsible for any damage to paintwork during vinyl removal, and we do not recommend application on re-sprayed surfaces or poor quality/rusted paintwork. It is the sole responsibility of the vehicle owner to ensure that the existing surface is suitable before the vinyl wrapping process commences. We would like to highlight that our experience indicates that removing vinyl designed for vehicle wraps from good quality, factory original paintwork will not damage the paintwork.

Agreement

This agreement constitutes the entire understanding between Evolve Auto Boutique and the CLIENT and shall supersede all previous proposals or agreements, whether written or oral, and any other communications between the parties regarding the subject matter of this agreement. This agreement may only be amended in writing and signed by both parties’ authorized representatives. Any terms not expressly set forth in this agreement shall be governed by established industry customs. Any conflicting terms on the CLIENT’s formal order shall not be binding. The CLIENT acknowledges that they have read, understood, and agreed to the prices, fees, charges, use of images, specifications, and conditions stated herein and authorizes Evolve Auto Boutique to perform all work as specified. The CLIENT further acknowledges that they have been presented with, have read and understood the color matching criteria, and have selected the appropriate method for the design. The CLIENT understands that Evolve Auto Boutique cannot guarantee the quality of any artwork that is not set up by Evolve Auto Boutique.

Changes to Our Terms & Conditions

Evolve Auto Boutique reserves the right to modify, supplement, amend or otherwise revise these terms and conditions without prior notice to its CLIENTS or CUSTOMERS. Such modifications shall become effective immediately upon posting unless otherwise stated by Evolve Auto Boutique. The most recent revision date of these terms and conditions is March 11, 2023.
